SUBSTITUTE TRUSTEE'S SALE

   Default having been made in the payment of the debts and obligations secured to be paid by a certain Deed of Trust executed August 23, 2021 by Byron K. Ledbetter, Jr., to Ryan S. Smith, Esq., as Trustee, as same appears of record in the office of the Register of Fentress County, Tennessee, in Book 346, Page 318, and the undersigned having been appointed Substitute Trustee by instrument recorded in the said Register's Office, and the owner of the debt secured, First National Bank of America, having requested the undersigned to advertise and sell the property described in and conveyed by said Deed of Trust, all of said indebtedness having matured by default in the payment of a part thereof, at the option of the owner, this is to give notice that the undersigned will, on Monday, August 26, 2024,  commencing at 1:00 p.m., at the Fentress County Courthouse front door, 101 S. Main Street, Jamestown, Tennessee proceed to sell at public outcry to the highest and best bidder for cash, the following described property, to wit:
   Situated in the County of Fentress, State of Tennessee.
   Lying and being in the First Civil District of Fentress County, Tennessee in the City of Jamestown about 4/10 of a mi1e northeast of the Courthouse, beginning on the west side of White Oak Road at the corner of Mrs. John Crabtree's lot and about 75 feet northeast of the northeast corner of the O.E. Chapman Lot, running thence north 36 degrees east with said road 89 feet 6 inches to stake, Lonza Mitchell's corner; thence north 86 1/2 degrees west 170 feet to a stake; thence southwardly 67 feet 9 inches to stake; thence with Crabtree's line south 82 1/2 degrees east 137 feet beginning.

SUCCESSOR TRUSTEE’S SALE

   Default having been made in the terms, conditions, and payments provided for in that certain Deed of Trust dated May 11, 2023, of record in Book 381, Page 658, Register’s Office for Fentress County, Tennessee, From CHRISTIE TINCH JONES a/ka CHRISTIE DAWN JONES, AND TERRY WAYNE JONES, a married couple, to Bruce Elder, Trustee, and a Modification Agreement – Deed of Trust dated December 18, 2023, of record in the Register’s Office of Fentress County, Tennessee, in Book 391, Page 788, securing the indebtedness therein described, which indebtedness is now due and unpaid, and has been declared in default by the lawful owner and holder hereof, and 
   The undersigned, JAMES REED BROWN, Successor Trustee, having been appointed Successor Trustee on July 2, 2024, of record in Book 400, Page 577, in the Register’s Office of Fentress County, Tennessee, to serve in the place and stead of Bruce Elder, Trustee.
   NOW, THEREFORE, I, JAMES REED BROWN, Successor Trustee, pursuant to said Deeds of Trust, having been requested by People’s Bank and Trust Company of Pickett County, the owner and holder of said indebtedness so to do, and by virtue of the authority and power vested in me by said Deed of Trust, will on Tuesday, August 27, 2024 AT 12:00 P.M., prevailing time, at the FENTRESS COUNTY COURTHOUSE In Jamestown, Tennessee, sell at public outcry to the highest bidder for cash (or credit upon the indebtedness secured if the lawful owner and holder thereof is the successful purchaser), free from the equity of redemption, the statutory right of redemption, homestead, dower, elective share, and all other exemptions of Borrower of every kind, all of which have been expressly waived by Borrower, the following described property in the 4th Civil District of FENTRESS COUNTY, TENNESSEE.

BEGINNING on an iron pin on the West right-of-way line of United States Highway 127; thence North 88 degrees 00 minutes West 2,820 feet to an iron pin on the North edge of Shady Road; thence North 85 degrees 00 minutes West 105 Feet to an iron pin; thence North 04 degrees 15 minutes East 248 Feet to an iron pin; thence South 85 degrees 00 minutes East 105 feet to an iron pin; thence South 4 degrees 15 minutes West 250 feet to an iron pen (sic) and also the point of beginning.  Containing 26,100 square feet (0.599 acre) be the same more or less.

TRACT III:

Containing 25,900 (0.595 acre) square feet, to be the same more or less.
Excepting, however, from the above-described property the minerals heretofore reserved.
Previous and last conveyance being a General Warranty Deed from Freeda Kay Shelton to Christie Tinch Jones, by deed dated May 2, 2022, and recorded in the Register’s Office for Fentress County, Tennessee, in Book 362, Page 776.

However, the property description shall control in the event of any inconsistencies between the description and address or tax identification number.
The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
Said sale shall be subject to any restrictions, reservations, conditions and liens of record applicable to said property, and is further subject to any County real property taxes against said property.

Twenty percent (20%) of the purchase price is due and payable at the conclusion of the Trustee Sale in the form of a cashier’s check endorsed to the order of JAMES REED BROWN ESCROW.  The remainder of the purchase price shall be paid in thirty (30) days from the date of the sale.  Personal Checks shall not be accepted.  For any amount the cashier’s check exceeds the purchase price, the Trustee shall refund said excess payment following the deposit of the cashier’s check into his trust account.
The sale is being conducted by an auctioneer and the purchase price will include both the bid amount and a buyer’s premium.
The sale of property is subject to tenants in possession, if any.
The sale held pursuant to this Notice may be rescinded at the Trustee’s option at any time.  Pursuant to TCA 35-5-101(f) the Trustee may adjourn the day of the sale to another day, time and place.
The Trustee is attempting to collect a debt.  Any information obtained shall be used for that purpose.
